Photos: Unsplash, HMKIS and De Beers Brands The Diamond Decree First, we’ll focus on North American diamond law, or as close as we can come to it, via the Federal Trade Commission (FTC). The FTC provides guidance on how diamonds (LGD and natural) should be marketed. Goal: Ensure that consumers are not misled by false claims. While the FTC sets these rules in the Jewelry Guidelines and the Green Guide, the terms are not legally binding . The FTC has taken precautionary action against eight companies that violated certain terms in 2019, but no law- suits were filed. Also, the Green Guide hasn’t changed since 2012, and again don’t expect them to uphold the law; they’re simply strong recommendations. Global organizations like the International Or- ganization for Standardization (ISO) establish canons for grading and terminology for natural and LGDs. We’ll examine such as we move worldwide, but again these are not laws . In the U.S., clear LGD ad disclosures are re- quired by literally spelling out wording as "lab- oratory-grown,” “laboratory-created,” or [man- ufacturer name]-created, although we’re using the acronym “LGD” herein. Ads in Europe, and a few in the U.S., don’t explicitly reveal LGDs as such. This has led to complaints from advertising authorities em- phasizing the need for conspicuous disclosure. Enter the Natural Diamond Council (NDC) and the World Federation of Diamond Bourses (WFDB) - they helped established one solid law in France: "Diamant synthétique" (synthetic di- amond) must be used in LGD advertisements. Engraving LGDs has become a standardized practice. This doesn’t mean all LGDs have full laser inscriptions, however. LGD engraving is not a legal mandate. Unregulated Laser-Inscriptions To date, the majority of LGDs carry a grading report from IGI, the same lab that stopped clear- ly denoting such on their LGD girdles. Now, these stones show an “LG” abbreviation with a corresponding grading report number accompa- nied with a printed LGD trifold. On the flipside, GIA, SGL and GCAL continue to engrave LGDs exactly as such with grading reports for LGDs.
